In I-140 form in the box where it asks "If in the U.S. Date of Arrival" was lawyer supposed to put the date of first entry in the U.S. (date when first time entered in U.S.) or date of the latest entry in the country, which is different from the first entry.

Our I-485 interview is on last day of this month. I got a copy of I-140 from lawyer yesterday (I-140 already approved few months ago) where he filled in date of first entry in the country in above question in I-140. I want to understand for my knowledge.

Thanks,

I-140 date of arrival is the last entry into US. Usually I-94 is also attached as a proof of this arrival.

In my case lawyer has described first date of arrival in US instead of latest one. However in I-485 date is correct (latest entry via road from canada to US). Since I had given filled I-485 to the lawyer it was a correct date.

I have AOS interview on last day of this month. Do you think this could be an issue? how should I explain USCIS officer if asked question on this? FYI: I-140 was approved 6 months ago.

I'm exceedingly skeptical that this will be an issue, but if asked, just tell the truth and that the company's attorney made a mistake. The I-140 isn't your petition, and barring outright fraud or misrepresentation any trivial mistakes the attorney made won't cause you a problem.

If asked, just tell the truth. So long as you were in legal status the entire time (or can claim 245k relief) it's not going to be an issue.

Thanks you for the response.
