Hi ..Guys
my wife is currently visiting India. She is going to use her AP to re-enter US.
She has the AP documents but she ha sa PHOTOCOPY of her 485 receipt.
My question:
Is it mandatory to have ORIGINAL 485 receipt while trying to re-enter US using AP ? or a Photocopy will do ?

Thanks ..

The rule states - 485 notice has to be in possession. Now word possession can have different meaning when it comes to interpretation in context of G-28 that she filled. (I am sure she must have filled that is why she has photocopy of same.). The 485 notice is in my possession could mean it is with my lawyer as he/she is reprenting me. As per the law, unless you allow such an interpretation, - it is impossible to justify G-28 for 485. Photocopy should be OK - she won't even be asked for it. But just in case she is asked for original - ask her to give number of lawyer who is handling your case.

Going by conservative interpretation of rule - if she is coming on AP - she needs to have original notice in her hand. Practically - no.

I used AP in May 2004. I had a copy of the 485 receipt and original AP. The officer did not ask for the 485 receipt copy. He just looked at my AP and passport. He said that until I get my GC, I'll have to go through a process of screening and I was escorted to a room where I had wait for 20 mins to talk to another officer who looked at my file and asked me the purpose of the visit and how many days I was out of the country. Later he stamped on my passport and I was good to go.

Which was your port of entry.. Are they taking inside the room on random basis or does every guy travelling on AP undergoes similar royal treatment.

My port of entry was Newark, NJ. I do not know if it was on random basis or every person using AP. "Royal Treatment"? Bull...

Thank You Guys ..

Thanks Guys ..

JK ...I have both the Original 485 receipts ( for me and my wife) ..
couldnt decide whether to send her, her original 485 receipt by Mail ..Some how I dont trust the FEDEX/DHL/or any other private service while sending important documents to India.

You can send it through FEDEX, where they give you delivery confirmation within 3 days maximum if sent to India. If they dont deliver, you have every right to sue FEDEX.. But you can believe with FEDEX.

NVC,
They don't need the original 485. Infact they never ask for the 485 receipt. I entered using AP and the port of entry was newark, NJ. The officer sent us to an inside room, Where we had to wait for 30 mins because you are in a Queue. In the room another officer called our name and looked at AP, verified it in their system and stamped the passport.
One thing I want to add is that: If you use AP then you are not photographed or fingerprinted.
