I'm a little confused about this automatic revalidation thingy

so here's my case

Canadian PR, finished 3 yrs and filed for citizenship in oct.
Came to US in Oct'3 on B2 and filed for H1B in Feb '04
H1B arrived Mar'04 and 1-94 for B2 expires end of Apr

I have to go to montreal to file my taxes

1) if i go to canada and come back within my B2 I-94 time stamp, do i *not* need H1 stamp to re-enter US?

2) if i go for stamping in toronto or montreal (which is better btw?) does it matter than i entered US on B2 and changed status to H1? would that reflect badly on my case?

3) Lastly, does anyone know of any accountants in the NY/NJ/PA or any other area of US, who do canadian filings?

Thanks

If you intend to work on H1 status then use H1Visa stamp to enter US

I don’t think you need to file Canada tax if you are not residing or earning in Canada. If you need to file Canada tax just for citizenship it is not must. I know 2 cases ,the Indian ladies who don’t work and just stay at home in Canada (Mississauga) and never filed any tax as they don’t earned any income to file the tax and got citizenship and no questions asked about tax

ginnu,

thanks for the response. yes i do intend to work on H1, infact i am already working on H1.

and as for canadian tax, well i did happen to work in canada last year and i have the T4's for it, so technically i am supposed to be filing taxes now for last year, right?

i filed taxed for all the years that i lived (and worked) in canada so all of a sudden if i stop for no good reason, it might hamper the citizenship process not to mention cause other problems, or so i imagine.

Thanks again for your reply.

If you had earned income last year in canada and were a resident you "must" file canadian taxes . You will need to file this tax return as "departing tax return " to inform CIC that you are no longer residing in canada. If you do not then they will still considering you as a canada tax resident for future years .
