Questions regarding traveling outside US while I485 is pending

Hi Ciba and Gurus,
I have few questions regarding traveling outside US after filing for I485 (my ND 03/09/01).
Me and my wife are traveling to India in August, both of us have valid PA and Ends but don\'t have proper -Visas (I believe). In my case I have valid H1 until mid 2002 but Visa on my passport was expired in May 2001. My wife has H4 visa on her passport but she applied for H1 transfer and got approved but never used that H1. Are there any risks involved in traveling us outside the US with these -visa statuses. Can\'t we reenter US without using Ends?

We have done our FP in June, are there any issues, if 485s are approved while we are not in US. How long can we delay getting AC stamped in our passports after they are approved.

Travelling to India

Hi,
I am going to file I -485 first week of August at CSC. I have planned to go to India in November 2001 . Now I am in H1B also I have valid visa stamping up to 2003. Can I travel to India with H1B status?
Please help me in this.

You can travel after you receive receiopt

If you leave US and you have EAD and AP you should be Okay. Either you should have valid H1 and have never worked using EAD you can reneter US on H1B. If your H1B has expired or don\'t have stamp on your passport for H1B you got to have AP to reneter US and EAD to continue to work. Once you use EAD your H1 status is no longer valid. and it can not be renued while staying in US incase you need to do so under the circumstances that you are layedoff and need to find another job.

One more question. Is there a time limit to stay out of the US when using Advance Parole?

If neither of you have ever been out of status, you will fine
travelling using AP. However, those who have been out of
status should avoid traveling even if you have AP in hand.
