questions regarding I-602

Dear All,

My asylee I-485 application was filed in 2002. So it will a long long time before it can be processed, as we all know.

However, I have married an American citizen and am planning on filing another I-485 based on that marriage.

My question is since I entered the country on an altered visa, it looks like I will need to file an I-602 waiver form. Should I submit the form now or should I wait for the INS to request it (as many of you did)?

If the I-602 should be filed now, what should I write on the application? The instructions are not too informative.

Yes you will need a waiver since you entered the country through fraud.

However you must apply on a Form I-601, not I-602. The I-602 can be used ONLY if you are applying as a refugee or an asylee.

The bad news is that they approve I-601s only in extraordinary instances. Most are denied. So your chances of getting adjustment throught marriage are quite low.
