My husband has been living in the U.S. on work permits for 5 years due to a previous pending marriage case that was denied last year. What is strange is that his case was denied, but they allowed him to renew his work permit last year. He has now divorced her and remarried me. Will there be any complications in his second application for residency? Could he file an I-485 concurrently with an I-130 since he has been living in the U.S. legally or will we need to go see a lawyer about this?


We are also planning to combine our incomes in the I-864. They need
Proof that the intending immigrant's current employment will continue from the same source if his or her income is being used.
What kind of proof will he need?
 
Will there be any complications in his second application for residency?
yes, if deportation proceedings for him have started. Or there has been an order of removal.

having a work permit does not confer a legal status on its holder. If his case was denied, he has been illegally present since the moment of denial.
