Hi -

I landed in Canada in Dec 2002 and retruned back to USA on H1B. As my USA GC is still in Labor stage waiting in Philly BEC, I requested my management to transfer me to our company's canada office so that atleast my Canadian PR is protected and they accepted my requested.

My questions are:

1. Management and lawyer told that my GC will continue and I can choose either 485 or CP after 140. Will this be Ok -

2. I wanted to maintain my H1B and draw us salary while living and working from Canada. But the lawyer says that is not possible. My management will follow what our Immigration lawyer says. Is this right.

Only reason why I was interested in Us payroll is, I can continue contributing for Social security which will take care off my retirement and wanted to return back to my country after I am done with 10 years of contribution. Now as I will be paid in Canada, I have to live extra years in USA either 2 or 3 years more.

Thansk for your response and suggestions.

In my personal opinion you have good management, who agrees to mainitain your GC application and is ready to move you to Canada.

IF I was in your place I would move to Canada to maintain my residency and come back on CP when my I-140 is approved.

Hi,

I am on L1 visa under AOS for US PR but I am not too optimistic since my I140 has been transfered to AAO for over 15 months and my lawyer is refiling LC, 140/485. My L1 term expire end Nov 2006.

I am thinking of applying for a Canadian PR and my company has offices in Vancouver and Toronto. My questions:

a) Do I need to have a job offer before I submit for my Canadian PR? Based on the scoring system, I qualify for PR.
b) Can I do my own submission or it is better to engage a lawyer?
c) If need a lawyer, how much the cost?
d) How long does this process take? What are the process? Is it as painful as US immigration?
e) If I chose to file now, do you think I can get my PR before end 2006? Do I need to have a work permit (eg approved i140 like in US) before I submit for PR status (like 485 in US immigration)?
f) Is there are links/resources I can go to get help?

Thanks in advance.
