Questions on I-130 and G-325A

Hi,

I'm a naturalized US citizen and filing a pertition for a sibling in China.

I have a few questions regarding the procedure and the forms:

1) What's AOS? This term is used a lot in this forum.

2) Will it be easier for my sibling to get approval for immigration to the US if he has a good job in China and speaks good English, or it doesn't matter? During his future interview, will they ask him questions in English or in Chinese?

3) Do I have to have a good job and have significant amount of asset in the US in order to sponsor his immigration?

4) In the application, I have one form I-130 and two forms of G-325A (one for myself and one for my sibling). Do I need to include some 2-inch passport-sized photos of myself and my sibling in the application?

5) Form I-130, Question D-1: If separate petitions are also being submitted for other relatives, give names of each and relationship

I may petition (I-130) for other relatives in the future. It seems that I'll need to provide the names of all the people I sponsor each time I file an I-130, will it make it difficult for other relatives to immigrate to the US since I've already sponsored my sibling?

6) Form I-130, Question D-2: Have you ever before filed a petition for this or any other alien?

I've only sponsored another relative's temporary visitor's visa (not immigration) and that relative returned to home country before his visa expired. Shall I select "Yes" or "No" for this question?

7) In form G-325A for myself, there are a few items:

Citizenship/Nationality: US or USA?

File Number: I assume this is my Alien Registration Number. I'm already a US citizen, do I still enter my Alien Registration Number on my green card?

(Maiden)

I assume that "(Maiden)" is for my mother. So I enter my mother's info on both lines ("Mother" and "(Maiden)")?

For several items, it begins with "Applicant's ...". Who is the applicant, myself or my sibling?

Last address outside the United States of more than one year

I've been in the US for 16 years. How do I remember the address before I came to the US?

This form is submitted in connection with an application for -

Shall I select "Status as Permanent Resident", or "Other(specify) I-130 pertition"?

In the big box at the bottom, it asks for Alien Registration Number, shall I put my A#? This is a similar question to the File Number. Since I'm a US citizen, shall I still use my A#?

Would appreciate your kind advice! As always, I've found you guys very helpful.

3. yes, you must qualify 125% of the current federal poverty guideline (uscis.gov)
4. yes, don't forget to sign them at the back
5. well if you haven't petitioned anyone yet prior or together with your brother's application then N/A
6. a visitor visa cannot be sponsored so no
7. I'll leave you to figure that out or others may answer that :)

FYI: it takes 8-10 yrs for sibling petition

If I petition for another sibling (say sibling #2) in the future, will #2's petition affected by this brother's immigration application?

What are you talking about???!! who told you that there were no photos required for form I130???!! please go to uscis.gov and look for the instructions for I130, it is clearly stated there that photos for both petitioner and beneficiary are required upon submission of the form!

I don't think it will affect any other future petitions as long as the petitioner and beneficiary for the said petition are qualified.

You can leave it blank. That info will be clear from the previous info on the form.


This form is submitted in connection with an application for -

You no longer need an A#. Leave it blank.

It's under the section "What documents do you need to prove family relationship." :)

iamthegreatest: see how easy that was to say without being so rude? :rolleyes:
 
If I were rude I wouldn't have answered the questions you know. and I wasn't being rude, I was just shocked that he didn't know that! There's a big diff bet that.

It seems that photos are only needed if it's filing for a spouse because it's under the section "1. A husband or wife, submit the following documentation:"

"C. A passport-style color photo of yourself and a passport-style color photo of your husband or wife, taken within 30 days of the date of this petition. The photos must have a white background and be glossy unretouched and not mounted. "
 
I have more questions:

1) It seems that my sibling should sign his G-325A form. Must I send this form to him in China so that he can sign (which may take several weeks), or can I sign on his behalf?

2) As for his address on form I-130, I translated it into English - Will uscis use the translated address to send correspondeces to him? Over there, no one understands English, and chances are that letters cannot be delivered if the address is not in Chinese.

3) There is discussion about where to interview, an overseas consulate or uscis. I cannot find this item on form I-130. Any pointer?
