Questions...mainly about lost passport/I-94/F-1 visa

Hi all. My USC husband and I are almost ready to file hopefully before July 30th. However, I got a few questions that I need answers before we submit the forms.

I lost my passport with the I-94 stapled in it and my F-1 visa. I know the F-1 visa doesnt matter anymore since I'm already out of status since Sept of last year. In some forms, they ask for a copy of my I-94 and the biographic page of my passport and my visa. Of course I can't produce them since I dont have them anymore and my replacement passport is still under process with my embassy. I included Form I-102 to my entire package in lieu of the I-94 copy that they're asking from me. Is that the right step to take? If not, what is the best option? And what can I do about the passport? Do I really have to have a copy of the biographic page as evidence? I'm pretty sure I won't get my new passport before the the 30th. How bad will this affect us?

Replies, suggestions and advices are very much appreciated.
 
I hope you filed a police report for the lost passport. You can attach a copy of that report and a copy of your consular receipt for your replacement passport. Also attach a letter explaining your circumstances. By the time your interview comes through, you should have your new passport. Good luck!!!
 
All depends on when you lost your passport and whether you informed the police and your embassy in a timely manner. Assumming you did, include a copy of the police report, a letter from the embassy confirming when you submitted an application for the reissue of your passport and a letter explaining the circumstances.
 
Well... I could be wrong, but I didn't think you need a copy of passport... A copy of your birth certificate (translated)....
And I was told you can obtain a copy of your I-94 via Infopass or by filing a form with USCIS...
As for visa page it sais:
Copy of passport page with nonimmigrant visa.
If you have obtained a nonimmigrant visa(s) from anAmerican embassy or consulate abroad within the last year,submit a photocopy(ies) of the page(s) of your passportcontaining the visa(s).
Since you have been out of status for almost a year, I assume you didn't get visa within the last year, so technically you can skip that...

Providing copies of the biographical pages of a passport including pages with visas, if applicable is to show the following:

  1. Proves identity. You can also prove this by submitting a copy of a valid Driver's License or State ID
  2. Proves legal entry into the U.S. - Important if you do not have your I-94. You may also request a copy by making an appointment via infopass depending on whether you have the time to do so
  3. Establishes Country of Citizenship

Inclusion of a copy of the relevant pages of your passport, although not officially required at the time of application, does help you establish any of the points listed, if you need to. It's a matter of personal circumstances.

I say, why not submit it, if you have it. There's nothing like too much supporting evidence.

I agree with you, but I thought the whole problem here was that s/he does not have it. If it is in process, s/he will get it hopefully before the interview.
 
Thank you all for the response. I included an affidavit of loss, the receipt of my passport replacement, and a copy of my original I-20 from school with an immigration stamp to prove that I was inspected upon entry and was stamped. I hope everything turns out alright.
