Questions about travelling on Advance Parole...

Hi,

Myself and my wife both are travelling to India in 1st week of January 2002. We both have H1 and H4 status respectively. We don\'t have any H1 and H4 visa stamps on our passports respectively.

Recently we applied for I-485 (Adjustment of Status) and got EAD cards and Advanced parole approval documents.

My lawyer says once you travel on Advance Parole, you lose you H1 and H4 status respectively.

Question is
1) Is it safe to travel to India? On which status?
2) Do we lose our H1 and H4 status once we use Advance Parole for entering USA from India?

Any help is appreciated.

your H1 or H4 is still valid after using AP

your lawyer\'s story is an old story and he does not update his knowledge base.

I think your attorney is right. Once, you use AP, you lose your H1B status. The other way is to get the H1B and H4 stamping done in India in your passport and enter US on H1B and H4 visa.
 
i think your lawyer is right .

As your passports are not stamped, you can not use them to reenter. At this stage after having Ap, there is no point going for stamping. Many people used AP to reenter into usa without any problem.
