Questions about re-entry after marriage outside US...

You appear not to be that smart, you wouldn't like Mexico very much, and you seem to be assuming that the Mexicans would even allow you to live there, maybe you enjoy gang rape in jail awaiting your deportation. Mexico has a lot better immigration laws than the US

You need to file for a fiancee visa, and get permission from the US Attorney General for him to re-enter. The 5 year ban is not set in stone, read his I-294 form. He needs to seek permission. Even if you marry in Mexico, he will still need permission to enter the US, you gain nothing by getting married.


My fiancee is from Mexico and was in the US on a visitors visa. He left the country every 6 months to renew it. This last time he went to cananda. Upon re-entering the US they border patrol searched his car and found evidence of him working in the us with improper visa (visitors). They said he cannot enter the US for 5 years and now he is in Mexico. So, I am planning on going to mexico so that we can be married and live there for 5 years if we have to! My first question is this: when we get married will it "cancel out" this 5 year rule? Will he be able to come to the US with me in the immediate future?
We are both very productive members of society and due to the type of profession (We ride and train horses for a living...it is NOT a rich profession at all) he is unable to attain a work visa.
I am a US born citizen.

While you may not agree with his style, dafortycal gives pretty fan good advice. His advice in this case is right on. So take the good and ignore the part you don't like.
