Hi, am new to the forum, so pardon me if I ask some basic questions.
My status :
Labor (EB2) Approved : Sept. 2005
140, 485 filed concurrently. Sept. 2005
Biometrics tests done in November 2005
140 : RFE in March 2006, sent the RFE docs in March 2006
140 Approved June 2006
Received EAD and AP in April 2006
I intend to travel to India. I believe I will be travelling on Advance Parole. My current H1-B is expiring in November 1st 2006.
Questions :
1. I will not be getting H1-B stamped while in India. I will come back on AP. (The current stamping dates in India will not let me have an appointment during my travel dates). Do I have to file for H1-B extension?
2.While I am in India, if I hear about my 485 approval, will they ask us for any appointments to show up immediately? Correct me if I am wrong but the FingerPrinting is same as the biometrics tests I have done, right ? My concern is, while being in India we should not get any notice that cuts our trip short. Is there a way of avoiding this ?
3. I intend to switch jobs. I believe my case is clear and AC-21 is not compulsory in my case. Correct me if I am wrong.
