Questions about filling in I864A

hi all.
I need to fill in I864A, here is my case. I am the sponsored immigrant, my wife is USC and a sponsor, We submitted I864 together with I485, I765 and I130. My wife didnt make 16,034 last year but myself, F1 TA, made 18,000 last year. At the first I864, we just sent her 2005 tax return and savings asset to qualify the 125% poverty line.
But we just got an RFE saying USCIS cannot determine if our household income meets or exceeds 125% of the federal poverty line.....
So I am considering to redo the Affidavit of Support, add my income to hers, put our tax returns, w2s, employment letter together. Can I do that? How to fill that I864A, some part is really confusing.

Who told you to fill out the 864A? I am not very familiar with this form, but I do not see how you can contract to sponsor yourself. The instructions say:
By signing this form, a household member who is not a sponsored immigrant, agrees to make his or her income and/or assets available to the sponsor to help support the immigrant for whom the sponsor has filed an affidavit of support.
Did you not include your income on the original Affidavit of Support?
 
I know there'es a way he qualifies, many people do it, they use their income. I just don't know what form he needs to fill out.

Complete the I-864A. The I-864A also states this...

A sponsored immigrant/household member who signs this contract agrees to make his or her income available to the sponsor to help support any spouse or children immigrating with him or her and to be responsible, along with the sponsor, to pay any debt incurred by the sponsor under the affidavit of support.

If you are the sponsored immigrant and also qualify as the household member, you can fill the I-864A. You can ignore the latter part of the instruction which tells you to use this form only if spouse or children are immigrating with the sponsored immigrant. Most of us here filled that form to include our own income and if USCIS wants it, they use it, else they trash it. Better than getting an RFE eh?? ;) I used my own income and filed the I-864A and the officer did not have any problem during the interview and told me it was fine.
 
Does you wife have life insurance if so include it as assets to meet the income requirment. Also to use I 864A yourself you may use it as long as you live with her ..aka part of the household if you guys are apart u cannot fill I864A

life insurance is not an asset ;) It is not readily available cash to support yourself or something you can sell and convert to cash.

are you sure, caz my wife is still in school and she made like 3000 for the past 3 years each... we sent our life insurance as assests and letter from her employers that she "will" be making XXXXX $ a year. I did not include my income and we did not get a RFE.... and our interview is on MAy 2nd

You're wrong Ari, if you kill your wife that automatically becomes an asset :D :D ...I know I gave you something to think about...but just, please don't do it :D :D

Seriously speaking, I think life insurance is more like a reassurance that in case...God forbidden, the sponsored immigrant has a material support, but it doesn't apply as an asset.

Continuing what i wrote earlier, an asset according to USCIS is something that can be readily converted into cash to support the sponsored immigrant incase the sponsor and/or the immigrant do not meet the minumum income requirement. This question would definitely be asked during the interview as i was asked the same question. I used my income to qualify as my wife did not earn much in 2005. I explained to the officer that i am using my income and i have filed I-864A and he was satisfied after i gave him my tax transcripts form 2004.

If the letter from employer states that your wife will be earning more than the minimum income requirement, then that is the reason you did not get an RFE, but during the interview, you will be asked for proof of this income. If your wife still does not qualify or if the officer is not satisfied, you can ask to add your income and the officer would probably tell you to submit another I-864/I-864A before he can approve your case

ya that makes more sense as I was confused about it. Ya I was going to take my 864A to the interview just in case . ;)

I didnt include my income the first time, this time, I will send out my tax returns, w2s and employment letter together with my wife's.
I neednt to fill I864A, cuz I am not immigranting with children, so I dont need.

And I wont submit a new I864. We havent lived together( officially, recorded) for more than 6 months. I know how seriously USCIS treat "Lie".

I havent got her employment letter from her HR yet, How sad!!!
