questions about cap removal

Hello forum!,

U know, lately if been wondering what's going to happen with the 1 year backdating benefit that we get when we received the GC....Is USCIS planing to remove it because of this new cap removal>??
One more tihng...I think from now on..most of the cases( almost all of them)..will be aproved by a judge so they can make it harder for a person to get asylum.and that sucks! Who thinks the same?

I think until they take care of the backlog for the people who waited one year before they applied for their adjustment of status, they can't change that rule. Wait, I shouldn't say can't, I should probably say shouldn't change that rule for backdating.
The answer to the other question is that there will be still asylum offices and there will be asylee who will get their asylum through asylum officers. Not necessarily everyone would get asylum by an IJ. But I agree, it will be tough to get asylum.
 
The one year roll-back rule is not subject to INS discretion. It is part of the immigration law for more than 20 years. Unless and until Congress changes its mind, you will get the one year backdate benefit.

Asylum Officers will still going to work and they will still going to promptly approve clearly meritorious asylum cases. The sky is not falling; do not buy buy the AILA propaganda.

I think immigration lawyers welcomes the tightens the new tight asylum rule. The more tigher it is, the more money they would charge to win their case.
 
1 year back dating = 1st year in asylee status .
because the 2nd year, you can do i-485 adjustment application.
