Questions about Advance Parole

Hi All,

I am going back to my homeland come July 4. I will be travelling with Advance Parole as my L2 visa already expired last June.

My questions:

1. Our lawyer submitted our I-94s when he applied for our I-485. Will this pose a problem when I depart?

2. I received 3 copies of Advance Parole from BCIS. Do I have to bring all copies or can I leave one here in the US so if in case something happens, I still have an original copy?

3. I know that Advance Parole does not guarantee entry to the US. What possible reasons could I not enter the US?

He supplied ORIGINAL I-94s?????? You never do that - you always need them on your person. BCIS knows that. Always submit photocopies. Shouldn't be a problem when departing, but don't ever do that again.

Take all 3. If you are worried, make a photocopy.

Being subject to the overstay bars, I-485 being denied in your absence, etc. etc. Practically speaking, if it's a straightforward case, readmission shouldn't be a problem at all. The only warning I will give you is that using AP means you will go to secondary inspection for them to fill out your paperwork, so if you are catching a connecting flight on the way back, expect a few extra minutes going through immigration.

I guess your lawyer should have submitted only the copy of your I94,if he has submitted the original then i dont know what the problem would be when you depart US because the airlines people would be asking for your I94, explain what happened and give them a copy of your I94 if you dont have the original, just give a try and let us know how it went after your return.

You have to carry all three dont keep keep anything here, if you want to be carefull keep it seperate but carry everything with you

Advance Parole can be denied if it is expired or your I485 has been denied, other than that there is should be no problem, but be sure to take your 485 recepit copy along with you, at times officers may want to see. other than that you should be fine, forget about everything and have good vaccation.
