Question: Travelling on AP!!!!! Please suggest!

Hi Guys,

My wife's I-94 and visa was expired in Feb'07. Due to child birth we couldn't file the extension on time and we had filed extension in May with a nunc-pro-tunc letter stating the same and it was approved in August. The valid dates on the new H4 are from May-2007 to May 2008 (as my H1 wud be expired in May'08).

We are planning for India trip early Feb'08. We haven't received our AP's yet, assuming we receive them before we travel, how safe is it for us to travel on AP without going to H1/H4 stamping in India, especially for my wife considering the above scenario. Please suggest.

If you have AP use it without any problem. Giving the above senario, there is a chance of adverse effect on here GC application and return, if for any reason H stamping is denied
