Question regd. RFE

Hello Friends,

I got REF. They're asking for ALL PAY STUBS, ALL W-2s & ALL Tax returns from the beginning (year 2000) and also my son's birth certificate.

I don't make enough money (less from labor certificate) and also i don't have all paystubs right from the beginning.

Any problem??? Please help.

Cant you request the HR department of your company to give you copy of all your backdated pay stubs. Wont they have history of your record.

This is scary because I was not sure that we are supposed to keep all our previous paychecks for more 2 years or more. I mean what happens if some of the paystubs get lost. Does CIS deny the 485 in that case ?

Gurus: Please provide input/experience on this.

want to know, why CIS asked so many documents on your case, is it a random check?
is there any discontinuous in your employment
history?

my HR only put my current paystub in its website ...

Hello Friends,

I've no idea whats going on with my case. First my lawyer asked me Employment letter, which i provided to him and now he asked all these documents.

I really don't know that what kind of letter my lawyer recd from USCIS.

Can anybody help me with this salary issue? My salary is lower than the salary in Labor Certificate. Does this will be problem???

Please share your thoughts.

1. Can you find out what your RFE letter reads and post it?
2. The key thing is your current salary meeting the prevailing wage?

What we have gathered from quite a few postings is that the Salary being less is not a major issue as USCIS has been considerate of the fact that the economy is not what it used to be. Although the wording if the EVL should be done well. That is what the attorney is being paid to do.

This is the first time that we are hearing of ALL pay stubs - W2s and tax returns for the past 3 years is normal.

I would strongly advice that you have your lawyer fax you the RFE or set up a face to face meeting before you reply. Also take a second opinion because of the criticality.

I got a similar RFE too on my I-140; they asked for all of my paystubs prior to filing I-140. I told my atty that I could only provide that current year's paystubs and my W2 and income tax filing proofs for all the previous years.

My argument was : what's the point to provide them a thick stack of paper (the whole year of paystubs) if we can just give them one sheet that summarizes the whole year's income (the W2). Despite my atty's disagreement with me he went ahead to respond to that RFE using docs that I could only provide and it got approved in a couple of weeks.
 
I think your lawyer is asking all this to make your case stronger........You should ask a copy of RFE letter from your lawyer..... If someone is staying in country since 5 years then it's unlikely to get all the paystub so far......

How many 485 case generally your lawyer handle at a time?? Looks like he is new player in this game and wanna make sure things go perfect..........
 
I agree with visa07. I think your lawyer is a bit paranoid. Ask him a copy of the RFE. They may ask for paystubs from last entry sometimes. THis many lawyers interpret as all your paystubs since you really entered US.
