Question Regarding Portability

Hi All,

Can you please give me a suggestion on my situation.


I have filed my labour application for green card with company A from Virginia when i was working with that company in May 2001. Then in August 2001 i have completed the project with company A and then joined as a permanent employee in Company B. In October 2001visa through Company A in my passport got expired. I didn't renewed it because my attorney told i got still proceed with my GC even without valid visa with company A.

In November, 2002 my labour that was filed through Company A got approved and with Company A support i have filed for I-140/I-485/AP/EAD in December 20002 by submitting

1) future job letter from company A
2) Financial Statements of Company A (For 140)
2) Latest Pay Stubs from Company B ( to support my wife)

My Question is will i get any RFE because i am proceeding with GC though i dont have valid visa with company A (but valid visa with Company B) and i didn't submitt paystubs with company A along with 485 application??? Also do i need to work for company A as soon as i get my EAD?? How long do i need to work with Company A after my I-485 is approved???

Could any one suggest me whether any way i might get into situation of RFE?? I have submitted all the documents as suggested by my attorney.
 
Getting a RFE does not mean rejection. At the time of RFE, all you need is a letter from company A saying that the job offer (GC is for a future job) is still valid. Or if the RFE comes after 140 approval and 485 has been pending for 6 months, you can claim AC21 and ask company B to reply to the RFE (if the job is similar).
