Question Regarding I-131 Rtd

B]QUESTION REGARDING I-131 RTD[/B]

I am an asylee & applied for I-131 Refugee Travel Document since March 14 2005 and it is still pending at the Nebraska Service Center. I have made several inquiries and the only reason they give to me is that the case is placed on extended review or security checks. I have also done congressional inquiries and they got the same answer. This same travel document was issued to me back in 2004 which expired on 06/2005. I travelled twice to the UK with the prior document. My I-485 is pending at the Texas Service Center, original filed at NSC but tranfered to TSC in January, 2006.

I am really confused as I need to travel back to the UK to complete my research thesis. I was on the assumption that my name check for the I-485 might delay the I-131 but my congressman office told me that the name check is clear based on correspondence received from NSC. Aslo, another congressman office told me NSC replied stating that the case is on administrative backlogged. The local USCIS office here in California told me that my name check is clear. I requested expidiate processing to the NSC for the I-131 and they replied back saying that the required background investigation on my case remains open therefore a decision cannot be made.

My question here to this forum is how was is it possible to grant me the previous document without completing the required checks as they claim? Why is there a processing delay of over 1 year on an RTD. Also they granted my EAD in february, I beleive they require the same checks for EAD & I-131 (IBIS)? On my I-485 I have submitted the requested Medical & Biographic information back in March 06, 2006 & also completed my biometrics (code 2).

Please forum, I am very confused and this delay on the issuance of the travel document causes me to have great anxiety everyday. Anyone with any spotlight or experience should help me explain. I have also contacted the CIS Ombudsman office and they wrote me back that they have initiated a formal inquiry with NSC & if I don't receive any response within 45 days I should contact them back.

Morning if you recieved the response from the ombudsman office, the next thing is the greencard approval...there was about two weeks when I got the ombudsman reponse and my greencard opproval..

Mr. petertherock77...Your concern is legitimate. If you are waiting for RTD over a year, that is, I think, out of the ordinary. Also, I think the USCIS has its own legitimate concern. If you travelled twice to UK since you were granted asylum, the USCIS my need to investigate what you are doing. You don't seem to be a typical asylum seeker when we look at your travel pattern. I suggest that you be patient and wait what they do.

The problem is I did not hear anything from anywhere. It seems that the only way to make them take it serously is sue their butt off. :mad:

Thank you for your feedback. I think because someone is an asylum seeker makes him/her suspicious when they travel out of country to a non-restricted area. I did not return to my COP neither did I travel to a region which is on USCIS watch list. My travel where legitimate because I visited the Cambridge University in England for my MBA Research Thesis which was based on a school referral to the Judge Institute of Management Studies-Center for International Business Research. I have all the letters from my University & proof of my intinerary to Cambridge which I mailed to NSC when requesting for the expidiate processing. My university recently issued a notification that my degree cannot be posted without proof of completion of final project.

I just think the USCIS uses the advantage of the law/position to do what they like. They should focus thier resources on people that pose a threat to the US not a innocent guy like me who is trying to be a productive member of society. Also, I have family in London & I have travelled with legitimate entry permit.

I did not send the old RTD at the time of my application because it was 3 months to its expiration when I applied for the renewal. One of the reason that I did not send it was because I had valid visas's on it. However, if they had requested it I would have sent it to them anyways.

Dear Faysal, Does one RTD travel times affect the processing of I-485 or later RTD applications? Or one can not travel to the same place one visited before? I am so scared.

Dear Coolguy: I am just an asylee as you are. My response is solely based on my opinion which is the use of common sense. The USCIS does not care that much ordinary people; People who work on the assemble line, and are busy with their lives. Once you get to point of conducting research at the graduate level, as our friend petertherock77 is, you become an important person so is your travel. Whether the travel is legitimate or not does not matter. Rememeber the guys who were involved 9/11 were legitimate visa holders; so the possibility of dual purposes is always there, and the USCIS may take time to investigate. Mr. petertherock77 I am in your same situation. I am also in graduate school but i don't need RTD. Because of the current admosphere, I expect some delays.

Also, there could be other posibilities. the Officer handling the case might have lost it the file in his stacks of cases.

So I would definitely travel if I have to, but the possibility of investation and delays is there...I travelled once, and when I was getting my greencard there were no question about it....
Mr. petertherock77 I know the pain and agony you are going through. If you can get another way to do your thesis that would be great;otherwise be patient and let the process take its time...

Excuse me petertherock77. Was the RTD expire or valid at time of your application for new one...
 
You should consider legal action against the USCIS (often having an attorney write a letter to the USCIS threatening to sue will do the trick).

Next Monday, go ask the USCIS Director himself. It is outrageous.

Thanks. I just submitted my complain. I think it is absolutely ridiculous how USCIS treat aliens in this country.

Support you! Petertherock77, It would be better for all of us to ask something even they may not answer them at all. At least we have to have them know we are not satisfied at their work.

I received a call from the CIS Ombudsman Office today & the lady told me that they received correspondence from the USCIS on my case & the reason for the delay in the processing of the I-131 is because I have an adjustment of status application pending which requires background checks/security checks. Until these checks are completed there is nothing that can be done on the case. Basically, she said the adjustment application is causing a hold on the I-131 & they don't usually grant a Travel Document if there is an I-485 that is currently pending adjudication. She also told me that they requested additional evidence from me lately on the I-485 & I should give them some time to get back with a feedback.

Finally, I asked her how long it would take before I get a response and she explained that It can take unspecified amount of time for the background/security checks to be completed but I should give them until December of this year. The lady was nice & she wished me goodluck on my case...

Forum... any thoughts, ideas? Do you guys think this is beleivable?

What kind of checks are these that they are talking about? The local INS showed me thier computer & my name check is clear, what else?

I personally know asylees with pending I-485 who had no trouble obtaining RTD's. Therefore, it's not believable.

The only way I see out of this massgrave called name/security/background check is a lawsuit, especially if you have a clean record.

I think you have just been a victim of what I would call a "quick hand shuffle" (an old Chinese game). Ombudsman office gave you a load of crap.
The reason I say that is because before this cap was lifted, it used to take on average 4-5 years for asylees to get a green card. In the meanwhile, majority of them needed to travel and they all applied and got their RTD while their I-485 was pending. I myself have received 3 RTDs while my I-485 was pending. I think they are just hosing you man... Talk to your Congressman to see if he can help. There were people who needed to travel on emergency basis and got their RTD in a week while their I-485 was pending so I find Ombudsman Office's response very strange and I'm kind of disappointed.

I have been waiting for approval of my RTD for over 17 months. Can I withdraw the application and file a new one? Will this make it faster or I should just sue USCIS? I have exhausted all my options, contacted congressman office, house of representative office, ombudsman office & service director and all the responses where similiar stating that my case is pending results of required background checks/security checks or in the security department. I think this is unfair because I have been granted the same RTD in the past & I also have an adjustment of status pending with the service.

Forum- do you guys think it might be the IO that is holding my case for no reason? Is it better I withdraw this application & file for a new one? Will that change anything? I need your advise on this because I really feel frustrated over this issue and I need to remove all these anxiety from my mind.

Your opinion will be much appreciated.
