Question regarding H4 stamping

Hai,

I came to U.S on H1B which was valid from 01/19/1999 to 05/03/2001. After it expired, got an extention from 08/07/2001 to
03/31/2004 and I didn't get stamping in my passport, for this period.

Recently, I changed my status from H1B to H4 which is
valid from 08/02/2002 to 06/15/2003.

Actually I'm planning to go to India next week, to get H4 stamping. I just got a news that visa processing are getting delayed and getting denied because of a lot of reasons. One of the reason for the denial is, not having a valid stamping in passport.

Problem is, I don't have a valid visa stamping in my passport. It shows my expired date which is 05/03/2001.

Question is,

Can I go to India to get stamping as I already
planned?

can I get my stamping without any problem?

Do they need any additional documents?

What if visa gets denied?

Thanks in advance.

seems like you have an out of status period. It is defintely a risk. The risk is mostly because of your visa changes.
If visa gets denied, you cannot enter USA.

Thanks for your reply Jaxen.

I don't understand, how do you say that I have an out of status. My employer applied for my H1B extention before it expired(receipt date 04/26/2001, expired date 05/03/2001)

As I mentioned earlier, my extention period was valid from
08/07/2001 to 03/31/2004. My H4 is valid from 08/02/2002 to 06/15/2003. So I was never out of status, even for a single day.
The only problem I have now is, not having a valid stamping in my passport.

Question is, will this affect my H4 visa stamping?

The time between 05/03/2001 and the start date of extension 08/07/2001? It is not sufficient that a H1 extension was pending during the period, the H1 approval should have been from the receipt date. Maybe there is a typo.
If you are sure that you were not out of status, you dont have to worry about getting the H4 stamp.
