Question regarding H1 Visa and Passport!!!

The H1B visa stamped on my wife's passport is valid till Feb'2005. Since her passport was expiring in June'2004, we applied for a new passport. We recently got the new passport along with the cancelled old passport, the H1B visa is not cancelled. Now we are planning a trip to India, as per my understanding we need to carry both the passports and show the visa in old passport.

If there is any issue is this, please do let me know.

--- That is fine, but I would like to know as you posed your wife passport is expiring in June 2004 how did consulate or DOS stamp the Visa in her passport till 2005 because they normally stamp the Visa sticker till passport expiry date. How did they stamp till 2005 when passport was going to expire in 2004? May be mistake of consulate official

------ Now your both passports are Married and staple the expired passport with new passport and keep always stapled and show both the passport at POE

aksmks, In this case, you have to carry both the passports all the time and it is better to carry all the passports (say if you have more than one). I had the similar experience....

Ginnu, If your passport is valid more than 6 months then consulate will issue the visa whatever the expiry date mentioned in the 797 approval notice for H1B cases.

Thanks a lot for your input. Can you please let us know if we need to carry any other documents along with all the passports. As you mentioned you have been in similar scenario, I will really appreciate your feedback.

The US Department of State should stamp a visa on your passport for the expiration date of your I-797 (Action Notice) or sooner (some countries has agreement for 2 years or less). The visa in your passaport is valid until Feb 2005 (does not matter if your passport is expired or not). If you need to travel overseas, you need to carry both passport. Even, when you switch to another company and get another I-797, you do not need get another visa (in fact, they will not issue another for you), unless you move for different visa category (example from L to H, etc.).
