My husband applied for his renewal of his green card almost 8 months ago and its still pending, I was reading up on some things and now I am really concerned and worried, He went to jail over 20 years ago but he did not get deported or anything and has been having a green card since I have known him. Doing the renewal process is he going to have trouble renewing it with this crime from over 20 years ago. Please help I am 7 months pregnant and really stressing out.

Was the jail sentence before or after his original green card was approved? If the jail time was before his first green card, did he mention it on the green card application? Has he renewed his green card successfully before?

He came here in the 80's that's when he originally got his green card, and he committed the crime in 94 and was in jail for a little over a year then was on probation, He renewed his greencard in 2003 and didn't have any problems then it came up for renewal again in 2013 and I am reading all this stuff online and I am just getting scared. When he went to jail his greencard was never taken away and he was never ordered to be removed from the US either. Do you think everything should be ok?

If the actual jail sentence was over a year (i.e. not something like waiting 8 months in jail for a trial followed by a 6 month sentence), and he was 18 or older, he probably is deportable, and wasn't deported at his previous green card renewal because they don't scrutinize criminal backgrounds very deeply for green card renewal when it's not an obviously major crime like armed robbery or murder.

But it depends on the specific facts of the case. At this point he can't do anything about it except wait, and don't travel outside the country until the new card is in his hand.

Another possibility is that he may have derived US citizenship through his parent(s) if they obtained US citizenship while he had a green card and was under 18 years old.
