Hello. A close friend of mine who has a daughter here has residency at this moment. She told me that she can apply for citizenship in March. Her daughter is an illegal alien who is now 18 years old. I don't really know the whole situation, like why she did not apply for her daughter's GC when she applied for hers, but I was just wondering if her daughter will be able to get residency/citizenship after her mother becomes a citizen. How long will this process take? I need as much information as possible, please. I want to help out her daughter. She's a nice girl who's not doing anything with her life right now because of her status. She graduated high school already but cannot go to college because of her situation. Please help! Thanks!

Oh and my friend got residency through her older daughter.

Once your friend gets het naturalization certificate she can submit an I130 application for her daughter. I think an adjustment of status also applies in this case, since her daughter is living in the US. Since her daughter is under 21, the process will be speedy( at least she will get a work permit fast) because she qualifies as an immediate relative. I suggest you check out www.uscis.gov, there is says what forms need to be used and where they need to be sent.

Thanks. How long will it take my friend to become a citizen if she applies in March? And when you said the process will be speedy, is that speedy as in 6 months or speedy as in 3-4 years?

I asked others for advice also on other forums and got negative responses such as it is nearly "impossible" for her daughter to get a green card. Is this true? I've been getting so many mixed responses that I am so confused at this point. I did research on the I-130 and I-485 and it seems like the I-485 will take a long time due to the name check. Does anyone have any more advice or perhaps a different approach to this problem? Really need the help, thanks.

Your friend... is you...

If you friend's daughter (YOU :p ), apply for this citizen and is naturalized before the end of this year, then he can apply for the daughter as soon as he becomes a citizen. :)

The key: apply before the daughter age out at age 21 yrs. Moreover, get the daughter to understand that is she gets married, he petition will be death before she knows it. Exception, if she marry an american citizen, then she will be in good shape... :o

How long a citizen process takens, pure luck and District Office. It can take a 3-6 months and at times, a 1 or 2.

How long will it take for the daughter to get her green card?

Thanks for all the replies (well, just turtle10 and al southner :p )

When you say your friend's daughter is illegal, do you mean she did not get inspected - at point of entry - or is she illegal because of an overstay on her visa?

overstay on her visa. she was uh i think maybe 5-7 years old when she came. Is that a huge problem?

what visa did she come in on? she needs to have her original I-94 card in her passport to prove that she entered legally - with a visa (or a visa waiver). If she didn't enter with a visa, then she cannot get a GC.

Once her mother gets her citizenship (within a year of filing), she will immediately file AOS package for her daughter together with form I-130. THe daughter shouldn't leave the States until she gets her GC.

P.S. A lot of illegal aliens go to college now.

No, as long as she entered the country legally!
The process of getting green card, provided that the mother becomes a US citizen before daughter's 21 birthday or marriage to a non-citizen, could take from 5 months to a year.
