Question Regarding EAD re-newal

485-Pending

Registered Users (C)
Hi;

My current EAD expires sometime in September 2001. My ND for I-485 is Sep. 2000 and hence I am not sure that my application will be processed by then.

My questions to the board are:

1. How much time in advance can I send the EAD renewal papers? I have heard 3 months is this correct?
2 Will the INS send the application back, if you apply more that three months in advance?.
3. Can I send the application by myself, without the attorney\'s help?
4. Has anybody sent the forms by themselves?

The reason, I am so concerned is I am out of my 6 year H-1 time and hence to be employed, I have to have the EAD.
Please share your experiences.

Bhanu, if you looking at this mesage, please respond

Thanks in advance

It is very important to realize that once your H1 has expired, you cannot work without a valid EAD! Therefore sufficient time must be
set for renewing an EAD.
Even though VSC has put a timeline for EAD processing between
60 - 90 days, they are currently approving EAD\'s within 3 - 4weeks.
However, there is no guarantee this trend may continue.
But if you apply for an EAD and VSC does not process your application within 90 days, on the 91st day you can get a interim EAD from
the local INS office. Therefore if your current EAD expires, say
September 10th, giving yourself 10 days for going to the INS office
and so on, you should apply i.e your EAD application should REACH
INS on June 1st.

You can apply yourself; you donot need an attorney for this
The above applies for renewal also.
I donot see any reason why INS should send back your application; No where INS states that you can send an EAD renewal only at a particular time.

485 pending,

do it ASAP. you have got a long time till sept but its not
worth putting off things like this. It costs 100 bucks to renew
so you better do it.

If you have the photocopy of the previous application for EAD.. Just
fill it out ( go to the site http://www.formshome.com ) and take the
application with the Money Orders to the local INS office..
You can get EAD in 10 minutes..
You can apply for renewal as early as 6 months in advance to the
current one\'s expiry date.
