Question regarding DV2022 Selectee.

I have a question regarding a complicated situation for a female DV2022 selectee. She has been selected in DV2022, she is going to get married in a few weeks, the man whom she is going to marry, is already married to another woman. The question: is that situation acceptable in the processing and the interview in the light of the DVlottery laws. As far as I read, polygamy is prohibited inside the US, however it is acceptable if it was practiced prior the entry to the USA.

Thanks in advance.

No, it is not acceptable for US immigration at all. Your future spouse will not be able to immigrate, and in fact your marriage will not be seen as a valid marriage by US authorities unless your future spouse divorces his current wife before you get married.

Here is the section of US immigration law dealing with polygamy

Void for Public Policy: Certain marriages that are legal in the place of celebration but are void under state law as contrary to public policy, are not valid for visa adjudication purposes.

(1) Polygamous Marriages: Polygamous marriages are not recognized as a matter of federal public policy. See Matter of H-, 9 I&N Dec. 640 (BIA 1962). Any prior marriage, of either party, must be legally terminated before the later marriage.
