Question on Visitor visa extension

My parents arrived in the US on June 12th 2010 on a visitor visa. Their 10 year multiple entry visa expires on November 13th 2010. The immigration officer gave them a visa till December 12th 2010. Can we apply for extension 60 days before December 12th. Do my parents become ineligible for visa extension since their 10 year multiple entry expired by then. Can someone guide me. Your help is highly appreciated.

Yes you can apply for a extension of thier non immigrant status while its valid even when their Visa will be expired, a US Visa needs to be valid for applying for an entry to the US, and they have already entered and are only applying to extend thier stay.
 
They can apply for EOS. The key is to have a genuine justifiable need to extend a 6 month visit even further.

Why are you already planning an emergency to require their extension of stay? You are jeopardizing their change of obtaining a new visa. Your plan is foolish.
 
Concerned4US - We having a baby in December hence we are planning to extend their stay. That is good enough reason for extending...am I right?
 
Actually no. Anything that could have been addressed with a better timed initial entry is not a good enough reason. Your parents arrived in June. They were already aware of the pregnancy (I assume). So had they delayed their visit and arrived in say September, they could have been there for the delivery and had no reason for EOS. This is what I mean by a better timed initial entry.

Triple Citizen is 100% correct. Poor planning on your part is not an issue to concern the USCIS.

You and your wife should be able to handle the care of an infant without "need" of your parents. They should return home and visit for the child's first birthday.
 
changing immigration status

i came into this country with a temporary B1 visa and i wanna ask if it is possible to change my status to a permanent resident

so even though i was given at least six months when i entered but i stayed for like 2 years.
