Hi,
My last name in my birth certificate is little bit different with addtional letter compared to my PR card and other documents. I had interview and the person taking interview asked me that the name that's in the birth certificate will be used for my passport and I said okay as I did'nt wanted any delay. And also they said that they need to follow whatever name is on the birth certificate. I will be getting a letter in few weeks time for my oath, so when can I change my last name? so that correct last name can appear on the passport. I appreaciate all the responses, thanks much!!!

Point would be which one is right. Is the birth certificate the correct spelling? Which spelling would you like in the passport? Could you handle this as a name change request? I guess it is too late as you already had your interview. I guess you will have to handle this as a post naturalization name change. I hope somebody else can give you more details, unfortunately I don't have any experience on name change. I would think that potentially you could do a court name change and if you want go back to USCIS and get a new certificate with your new spelling, however that's got to cost some pretty penny.

No, I do'nt want the name that's in the birth certificate. So my question is: without causing any delay can I:
1. At the time of oath correct my name if possible
2. Or after getting my naturalization certificate, can I change my name while applying my passport.
I did'nt realize it will be a issue.

I'll let someone else answer, but I think:

1. No, as it is not a typo on the USCIS part, but a typo on your birth certificate. I doubt they will change it. You should have taken care of this before you got to this point, it is not USCIS problem.
2. I don't think the Department of State would look kindly into giving you a passport under a name that doesn't match what is in the naturalization certificate.

You can definitely try 1, but the possibility of success is small. Your best bet would be to get it fixed at point 1, as point 2 won't probably work.

Sorry to hear this, but in a way it sounds like something you should have taken care long time back with your register of birth office.

Usaimmigration,

Once you get your Natz certificate, then you can try to correct it.

It WILL cost you more $$$ than what it could have before. But, thats probably the cleanest option at expense of more $$$

You might be able to ask them to delay the oath and find out if they will entertain your request for a name change. Otherwise, to do it post-naturalization you'll have to go through the court process in your jurisdiction, which may involve hundreds of dollars in fees and use up a lot of your time running around from one government office to another.

Which local office did you do the interview? I think some offices do name changes and some don't. Anyway, on hindsight it seems that the cheapest and easiest way to do the name change would have been during naturalization. As pointed out it will cost you more money and effort to change this after the oath. You might try to fix this on the day of the ceremony, but my guess is that it is not going to work. I mean that they most likely won't change the name on the spot, but perhaps you might convince them there of giving you a new date and the name change. That's all daydreaming, don't take that course of action very seriously. Perhaps what you could do is schedule an Infopass and explain the situation. Go there with a good amount of official documents, bank documents showing the spelling you prefer and that I assume you have been using over the years and ask them that you would like that name to appear in the certificate and that it doesn't matter to you if it takes longer to get a name change in a judicial ceremony. Please let us know what happens to your name situation.

My 2 cents.

It was at West palm beach office, Florida.
What's infopass, is it getting a pass so that we can meet some officer to explain the situation?? How do we get the infopass? Thanks for all your replies.

Yes, that's what it is. Crosshairs has already given you the website for this. Believe it or not I have never scheduled an Infopass so I am not the right person to ask what choices you have to make to get the appointment.

Thanks much for the information, I scheduled apptment for next week, does any body know how it will be? Do I need to explain them my situation? Thx!!

Thanks, I am going to explain them everything that happened at the interview time. I will tell them that I want the name that's on my dr lic, social sec card and all my bank docs. I will request them to give the apptment date if possible as I have an international trip which I have to go at the end of this year which has already been scheduled. This forum has been really helpful to me without which I would'nt have known about infopass.
Thanks much!!!
