Question on the form 156

Hi, all:

In the revalidation application form, I answered "yes" to the question on whether someone has filed an immigration petition on my behalf.

However, an immigration petition has not been filed on my behalf, I have yet to clear labor certification.

Is this going to create a problem ?

I don’t think it is going to create any problem for Visa revalidation
many have done this kind of innocent mistake in past and got visa revalidated.
many have not written name in native language in column 3 of DS-157 and they got the Visa
 
filing labor is NOT = filing an Immigration petition

It is only 485. The problem is u could be asked to bring supporting docs for this , which may be a problem .

Filling I-485 is NOT immigration petition it is adjustment of status application filed by employee

Filing I-140 IS immigration petition and that is filed once LC is approved and is filed by employer

DOS is not going to ask the supporting documents. Many have filed I-140 and they just written YES and they are not supposed to provide the receipt # or case # or copy of it. Read the DS-156 form instructions clearly they don’t ask for any receipts or documents related to LC, I-140 or I-485

“LC_Virginia “ will get the Visa revalidated if he /she has no other issues
 
In my case, my GC is sponsored (concurrently filed - I 140 approved and I-485 being processed) by another employer as a future employee.

I'm answering "Yes" to the question on whether someone has filed an immigration petition on my behalf.

Also, I have put the sponsoring company's name for the question "If yes, who?"

Will this create any problem?

I am applying for H1 revalidation. Also I had applied for 140 and 484 for me and family . While a applying for my daughter H 4 revalidation, what should I write in

“ Has any one applied for immigration petition on your behalf”

My wife is working on EAD . What is her status H4 or EAD?
 
I am an Indian national who is on H1B in the US for the past 3 yrs. I recently got laid off and in the process of getting a new job. The new employer is willing to process my H1B.
