Question on Naturalization Application

Dear Esteemed Gurus and Fellow Immigrants,

I am not sure if this is the right forum, but I do have a question concerning naturalization. Although this is few years away, I want to check with my good friends here about this issue.

My EB3 I-485 was approved on 7 February 05. Based on this timeline, I will not be eligible to apply for naturalization until sometime in Nov of 09. Last year, I got married to a girl, who is an U.S. Citizen. Now, given that I married an U.S. Citizen, does it shorten my wait time from 5 to 3 years? Or, do I still have to oblige by my 5 year waiting period since I got my permanent residency through employment? Please advise.

Thanks,

Japanese

Neither one. The way you obtained your permanent residence is irrelevant.

You can apply for naturalization after you've been married to your citizen spouse for three years.

For example, if you got married in June 2006, you will be eligible to apply in June of 2009. The three year clock starts from the date you got married, not from the date you obtained your permanent residence if you want to naturalize on the basis of marriage.

You will be able to apply after 3 years minus 90 days from the date of your marriage to the U.S. Citizen spouse.

That is not correct.
You can apply 3 year minus 90 days from the date you got your Green card. But on that day that you apply, you should have completed at least three years of marriage.

Absolutelly correct. Residency first, than marriage.....

Permanent GC or Conditional GC?

Hi,

I would like to know does it starts to count on the date that I received the conditional GC or the permanent GC before I can apply for citizenship?

Thanks very much.

The clock starts ticking since you were issued your FIRST GC, i.e. in this example condtional GC.

Actually, there is no difference between conditonal and permanent GC, except for the fact that you have to clear conditions on conditional GC after 2 yr period.

To verify your official date, look at your green card and notice date written under "Resident Since". This is the day you should count in terms of your citizenship timing.
