Question on My Permanent Residency

Hi,

I landed in Canada on 26th May 2001. Came back to USA couple of days later. Obtained a RRP (Returning Resident Permit) for continuing my studies (RRP was valid till 28 December 2002). I gather now under the new 2/5 rule, my time spent outside Canada on RRP will be counted days spent in Canada for residency purposes.

I would not be able to return to Canada before December 2003 to apply for my maple card. My question is, can I drive to Canada (from USA) after December 2003 on my own car or rental car using my old IMM document? and, based on my landing records and time spent on RRP how long (till what date/year) can I stay outside of Canada?

Here is your answer

Nope you can not enter using IMM paper after 2003 december. There is a way around. You have to apply for the permission to Canadian consulate here in USA and get some papers from there if you are entering after 30th December 2003. If you are interested in finding out more about how to contact and get these procedure done to get temp. re-entry permit then visit cic.gc.gov and over there they have all the inforation available.

I have gone through it and it is going to be helpful especially in your case.

I had same situation and got my PR card and they also consider my RRP time as time stayed in Canada.

----- You can enter Canada after 31 December from US in your car or your friend car or can cross the Niagara Falls rainbow bridge by foot; PR card is only needed for travel by AIR, BUS, RAIL, boat (commercial carriers). If you want to travel by commercial carrier then only you need the one time travel document from nearest Canadian consulate.

---- You have to count the time, one can stay out of Canada 3 years in any 5 years to maintain PR status, but who tells the correct time to Canada immigration at border post? All say that they went to US last week because Canada does not keep records of your exit from Canada.
