My father is planning to get my younger brothers and mother to US. He was not able to file tax returns for year 2003 and 2004 due to unemployment. I asked him to try to file for these 2 consecutive years but he was able to file for 2004 only. The tax return for 2004 is very mnimum. But for this year 2005 he already has a stable job and will be able to file for income tax with above poverty guideline salary by next year 2006.
In filing for I864 if my father wouldn't be able to file 2003 tax return since he was really unemployed then. Can we file I864 with the 2004 and 2005 tax return only and provide a letter for year 2003 stating he was not obligated to file because of unemployment. woud this filing be ok?
Anyone can share idea on what to do about this situation?
