Question on I-485 Issue

Hi Guys,

I have my I-140 approved long back (6 months). My employer didn't not inform me anything about it & now before filing my I-485 he is asking to sign a agreement that I'll HAVE to work with them for 4 years. If I'm not ready to sign agreement he'll not file I-485. I don't have more time on H1 so I can't xfer my H1 to new employee.

Any Help would be appreciated.

We all sign work contracts of one type or another - but I dont think a contract of this type is enforceable under employment law. I had a very similar situation where a company I worked for asked me to sign a contract that said I had to pay a sum of money if I left.

What did I do - I signed it of course! All the while having a chuckle to myself as I KNEW they could try all they liked - they wouldnt get a penny out of me.

My feeling is - the only regulation you have to worry about is the one where the USCIS likes to see you work for your employer for a "reasonable" amount of time after GC is approved. If you cant bear it - file I-485 and move using AC-21 after 180 days (if applicable at that point, given the changes in processing tactic for concurrent filers).

I have seen some consultancies do this. I am not sure whether those are valid or not.

You may need to talk to attorney.... Any other folks who has seen similar situation....
