Question on H1B

A friend of mine came to US under H1B for a company but she went back to her home country after 2 months. Her visa is still valid till 2003 April but in the mean while she is now got a new job offer in US for another company and they have applied for new H1B.

Her new H1B with this new company is approved .Does she have to go to the Consulate for a fresh visa stamping before entering United States? Her H1B approval notice "mentions the place of consulate ". Does this mean she has to go that place and get a fresh stamp. If so how long will that take and will that be a risk.

She received legal advice that she can carry H1 approval notice but need not get a fresh stamp bcoz her H1B visa is vaild even though it is for the old company. what do you advice????:confused:

allows h1 portability which grants the no need to stamp option.

There is no risk in either getting the stamp at the consulate or using old stamp and new approval to enter US. Both are ok.

If there are no issues involved, I guess better to get passport stamped based on new approved H1-B before coming back....
