Question on FBI background check

I did my finger printing late Jan 2008 and got my Interview letter scheduled for end of May. Does that mean I cleared background check or I cleared the finger print check? Are they two different things? According to one lawyer I spoke to, finger print clearance doesn't necessarily means background check.

He also says that they might sent interview letter before FBI clearance and might hold my application after interview until it's cleared by FBI.

I find it hard to believe. What do you guys think?

Seems like they have changed their process and are sending IL even before someone passes BC. Not sure though... there are other threads that talks about this... are you in army by any chance?
 
Background check = fingerprint check + IBIS check + FBI name check.

The first two of those are always completed within a few days. The name check usually takes a few weeks, but for some it takes several months or stretches out for years. They usually don't schedule an interview until all three are done.

Does that I mean I cleared FBI background check or finger print check?
 
Since you received IL you have cleared name check, unless USCIS reversed their policy once again of not scheduling interviews before name check clears.
What have you been arrested for in the past?

Oh yes, I remember your case now. Are you finally decided to have a lawyer present at your interview?
 
I am in a similar situation. I got my IL, but I am not sure if my name/background check has been cleared. From what I read there is a divided opinion on whether IL is issued after the name check is complete. So I am not sure what I should do.

Do I need to call FBI and find out if my name check has been cleared ? I dont want to nag them if its not needed to confirm the name check.

I dont want to go the interview and then find out that I will have to wait for the name check to be cleared, not that I have any other choices, but it would be nice to know beforehand.

Your background check is done else you would not have received the IL.... earlier they used to IL before background check (before your processing time). So don't panic.. you are done.

They used to schedule interviews before FBI name check cleared.However, USCIS changed this policy early last year since they were being sued by applicants who didn't receive a decision on their case within 120 days after interview. The policy now is to schedule interviews only if the FBI name check is cleared.
