matter

Hello All,

I need some clarifications on changing status from F1 to H1b and would appreciate some responses from fellow members here.

1) Should i go back to (INDIA) compulsory to get the stamping (or) can i go to other countries like Canada/Mexico. What's the rule says and what's recommended?

2) My Student OPT expires on july 20th and i already have my H1papers(I-797) from my company. Can I

i) Return back to US with my student EAD if for some reasons my stamping gets rejected if i go for stamping now.

ii) What are my options of coming back to U.S if the stamping gets rejected ?

3) What documents (other than the regular INS documents) like affidavicts/paystubs/company info that i need to carry with me when i go to india/canada to get my visa stamped.

I appreciate all replies/experiences related to this question.

Thanks

You can get the visa stamped in Mexico or Canada. If you have all the documents and have been in legal status throughout your stay in US, you should not have any problems. I got my visa stamped in Mexico last month without any problems. (mine was also a F1 to H1 conversion)

You can go through Victor Garcia - check his website at http://www.victorgarciainternational.com which lists all the documents required. People have also posted their experiences in his website at the following link:

Hope this helps. Good luck.
