Hi folks - My conditions were officially removed this past September 2009 and I have already received my green card in the mail. My husband wants to finalize a divorce ASAP, however; I am concerned that I might have to wait the 6 months of legal separation in the state of Virginia to not raise any false suspicions that the marriage was not entered in good faith. The marriage was entered in good faith, however; problems escalated at the beginning of this year and he moved out the first week of June 2009. I never informed USCIS that we had separated since he was on my lease until October of 2009. Can I divorce now? if not, how long do I have to wait?

You were not divorced when the I-751 was approved. Were you still living with your spouse when it was filed and approved? If that is the case, you should not have any USCIS issues.
