Question: Maintaining status

Hi,

The I-485 application for my wife and me was filed in Oct 2000 and has a ND of 10/18.
We have EAD/AP. We plan to travel outside US on vacation. I have not used my EAD
yet but my wife has used hers. My H-1 is valid till Oct, 2002.

When we get back to US, she needs to use her AP since she has used her EAD.
My question is: Can I use my H-1 visa to get back and remain on H status until
the I-485 gets approved (hopefully in a few months time). Will there by any problem
at the port of entry if I use my H-1 and she uses her AP to get back?

I don\'t think that there would be any problem with you using the H1 and your wife EAD. Carry your AP with you just in case it\'s needed.

That is perfectly alright. I did the same thing a year and half ago.
