Question for st4rguitar regarding multiple PERM?

Question for Great Gurus on Multiple labors

Hi gurus,

I have a few questions for you. Pls answer to best of your knowledge.

I have a certified labor from Dallas backlog in EB-3, going to file I-140 soon.

My employer has agreed to file an EB-2 in Perm for the same position by changing the Min qualifications to master's as most of the people working in this postion are either doctor / masters or BS + 5 yrs.
My questions are:
1-Do you think it will get stuck at PERM as i already have an EB-3?

2-Would changing the min qualifications to masters, have a negative impact?

Is your new EB2 filing Masters + 0 years experience ?


If yes, I am in the saem situation as yours.

Me too with a slight variance

My employer is also planning to file under EB2 for me for a different posn. I do have 5 years of exp before joining the current company.

I also have an approved 140 under EB3 with Jan 03 as priority date
 
Masters + 6 months

This is what my attorney decided to do although I have more than 5 yrs exp in home country.

Sorry for the delayed response, I was out of town.
As long as you have not filed another PERM case under EB3 or EB2, you shouldn't have any problems getting it certified and getting an I-140 approved. If you HAVE filed a PERM case, you will probably have some trouble doing a second filing. We are beginning to receive emails from the DOL indicating that the first certified application should be withdrawn... stupid people.

I have another question for I-140 step. I know this is not the right forum but I have it posted on 140 forum and nobody answered it. Again, I am turning to you for help.

I am getting my paperwork togather for 140 and 485 step to do concurrent as soon as I get Perm certified. My attorney wants me to provide a copy of my marriage certificate along with my divorce papers to prove that my daughter was born while I was maried to my ex. In my opinion, her birth certificate shows her birthdate as 06/23/1986 while divorce papers have a date of 1997, isn't it pretty clear that she was born 11 years before the divorce?
Do I still need to provide a copy of my marriage certificate as I am not sure if I could get a copy from my home country?
Is there a chance for RFE or denial 'cause I do not have my marriage certificate?
Pls help!
 


You are so very welcome !! It is good to have someone in this forum say 'thanks' instead of trying to contradict every point I make. Eesh.

We receive a LOT of RFE's for marriage and birth certificates. Better to give them everything they want now than have them ask for it later and further delay things.

I found the marriage certficate but it is in "urdu", my native language. Who is elgible to translate it and how do I do it?
