Hello cchong-

I am confused by the discussion resulting from my earlier thread as to whether I need advance parole or RTD to travel overseas after my application for adjustment of status has been filed. I plan to travel to the UK in a couple of weeks and since I know you have travelled to the UK after filing your I-485, need to see whether you had a RTD or AP...and whether you had any problems.

Thanks...

hatari999,

I travelled on my RTD (I have never applied for AP). Some of the officers in UK might not have seen the new light green color RTD, but they are familiar with the US issued RTD document. You will not have any problems.

You do need to apply for a tourist visa. I have applied for a UK visa twice. The first time I applied for a 6-months visa, and the second time I applied for a 1-year visa. There are no differet in requirements between the 6 months and the 1-year visa except the fee.

All you need is an RTD. Never surrender your original I-94 (which was given at ASylum approval) but carry it with you for additional security. A drivers license will also help. That is all!

correction guys

Once you apply for I 485 status, you need RTD & AP both. Apply for AP at local office and RTD at Neb. Check the main website and click on asylee section, it clearly states this. Once your AP is ready they will mail a letter to you, come and pick it up, also depends on office, some local offices give you AP the same day, and some take around 2 months.

Read the I-485 form. You do not need an AP if you are an asylee, period.

The rule is very simple.

The requirement for advance parole only applies if the I-485 is filed under section 245 of the immigration law. Asylum-based I-485s are processed under section 209 of the law and the AP requirement does NOT apply.

An asylee needs only a RTD to return to the United States, regardless of if the asylum-based I-485 is pending or not.

It is NOT in your interest to use AP. So forget about AP if you are an asylee.

Good to see you Gilbert! :)

I am no longer a regular visitor. But after getting six different emails from people on this same issue, I thought that I should clarify this.
