Question at POE

This question is for all GC holders - Stamp or Card who have travelled overseas after they got their stamp/GC.

Were you asked as to who your employer is. Were you also asked whether that employer is the one who sponsored your GC.

Reason I ask is that a number of people have used AC21 and in many cases either intentionally or due to situation have not informed USCIS.

It would be interesting to know also what they replied if this question was asked.

No. I've travelled twice outside the US, both times to Canada. Re-entered once via land (at Niagara Falls) and once via air (Toronto Airport). First time they just looked at the Green Card, swiped it and gave it back, after asking me how long I was away. Second time, I was asked who sponsored my permanent residency. I responded, "my employer". That was that.

I used AC21 twice, but was interviewed and am with the same employer I was with at the time of the interview.

Well, JoeF said if you switch jobs under AC-21, the new
employer is now your new GC sponsor, so if he is
right, then you can say your new employer
when they ask "who is yoru sponsor"

Thats not TRUE. It has been discussed at long and Rajiv Khanna commented that "After using AC-21 ,new employer doesn't become sponsor ". Sponsor is the one who approves labor,I-140 and supports 1-485 application for GC applicant. Period.

Good points.

The reason I asked is because one would like to be honest in dealing with USCIS or any government body but these laws are so fine that I don't think that POE officials maybe aware and you may have to spend a lot of time and energy trying to explain something which is in grey area.

In my case my GC got approved 3 days after I changed my job to a new employer. I had taken care to satisfy all provisions of the AC21 law but before I could even get HR to type the letter my approval came. My lawyer said that there was no point in sending in the documentation then.

So this brings up the original question.

The reason why good attorneys charge a lot per hour is that they know exactly what to say while all the time telling the truth. You can answer the question this way:

Your employer sponsored your Green Card. You have not changed employers since you became a Permanent Resident.

Anything inaccurate with that statement?
