Question abt I485

Gurus,

I have tremendously benefitted with the forum. I have a question, hope you guys can guide me.

Here is the background.

I worked for Company A, labor approved in Aug 1999 and I140 Approved in May 2000.
I left company A and joined company B in Nov 2000. Filed Labor in Company B in Apr 2002. Labor still unapproved yet.

Recently my lawyer said, since you have I140 approved from Company A, let's try Filing I485.

So I filed EAD and I-485 in April 2004. They had approved my EAD in July 2004, also I filed portability documents under AC21 in Oct 2004 (6months, under the rule, i-485 filed more than 180 days and case unadjudicated)

I have 7th year H1 extension approved untill end of 2005.

Now my question is
1. if I have to leave company B or I am laid off by Company B. Will it jeopardize my GC or I485.

2. What are my options. Can I join any other company with H1.

3. What if company A revokes I-140.

4. Do you think my I-485 will get approved or Denied.

5. Have you heard any cases like me.

Please help. Thanks a lot for your valuable input.

---- if company A tries to revoke the I-140 NOW ten you are safe
4. Do you think my I-485 will get approved or Denied.
--------- if employer A has NOT send letter to Revoke the I-140 before your pending I-485 hit 180- days then you are safe
5. Have you heard any cases like me.
------I know about 5-6 cases in similar situations were approved and in 2 cases employer never revoked the I-140 and in 2 case employer tried to revoke the I-140, when pendingI-485 hit 180 days. one case was intresting past employer never revoked I-140 but he filed new I-140 for new employer based on same LC but the other person got the I-485 approved and I dont know what happened to the person who used the same LC for his I-140

Question abt I485.

Gurus,

I have update on my case, which I would like to share with You.

I485 :- rd 04/29/2004.
FP Done :- 02/28/2005. I was able to prepone the FP scheduled date, it was originally 03/29/2005, as we were expecting a baby during that time. I went to INS office and talk to the officer.

04/06/2005. Recd RFE.
The site states we mailed a notice requesting additonal evidence or information on this case.
The notice explains what detail information is required.

I am worried as what the RFE might be. Has anybody received RFE in the similar case as I am.

Update for I485.

Gurus,

I have some update to share you. :)
After responding to RFE back in April 2005, today I received 16 magical emails that my I-485 is approved and the approval notice has been sent.

I am happy now but still finger crossed, :confused: as you know my complicated case.

Now my worry is 1. Do I need to go for passport stamping.
2. Is is required.
3. Will they ask, who has filed your labor and who has filed your I-485.

Do you see any problem here.

Again Thanks a million to All who shared their experience and provided guidance during the entire GC process.

I wish everybody luck who's still waiting for GC.

------------YES, if at the time of fingerpring at ASC they did not take your photograph
2. Is is required.
------------- YES, becase you need Passport to be stamped with temp GC
3. Will they ask, who has filed your labor and who has filed your I-485.
------------- they will ask for I-485 approval notice and will stamp the passport, take your DL, EAD, AP, I-94 and 2 passport Photographs+infopass
Do you see any problem here.

1. Did you attach EVL from company A when you filed I-485?
2. What's in the RFE?

------------- wait for answer from"vcgc2005" I think he did not attach EVL with I-485

2. What's in the RFE?
------------ It seems USCIS asked job offer letter and he used AC21 and sent new employer job offer letter
