Guys.
i am getting a bit confused with some laws .

what is our status after getting an EAD. does our H1 become invalid or we can still continue to be on H1.
how do people change jobs on ac21. do they use ead or h1. ??. i found out that if u used ead and then 485 got rejected there is nothing we could fall back upon. could we fall back on h1 if we used that to change the job.
people please share ur experiences.

See this - It would help you understand portions of it ...

Basically, try to keep H1 for as long as possible -- EAD should be your second option always.

re:

so this means that changing job using ac21 is not as simple as saying 'i have a ead . do not need sponsorship'. u might need to still transfer ur H1.

Well, yes if you want to use ur H1. If you want to use your EAD then you can say

'i have a ead . do not need sponsorship'

Yeah - just as rk mentioned....

but if your 140 is not yet approved, don't use your EAD - too risky.

Also the usual risk that you are aware of -- rejection means that you are out of status immediately !

Your call :)

Well... I am confused. If your I-140 is approved, I-485 filed and 180 days past and now if you want to change the employer - can you still do it with H1 transfer instead of using the EAD.

In this case does it tarnish the GC processing as a whole.

Dont think so. GC processing is for your future employment. H1 or EAD is the choice of your current status.

A little more clarification needed:

My empoyer is company A with whom I work on h1. Also I have my EAD (I-140 approved) and 180 days have passed. Now if I want to join company B, can I join them with H1 transfer. Is there any risk associated if I work on EAD with company B.

read max2k1 reply. Its safe to use H1 to change company because in case of GC rejection you will be still in status, ie on H1. If you use EAD and if the GC is rejected then you will be out of status.
