is it possible to do AOS if u win the DV but have been out of status for 3 years? If AOS is possible, what fines would be imposed??
 
thanks, LucyMO.:) Could you tell me if going back to my native country to do CP would be advisable in this case or is there any fines i could pay to reinstate and do AOS instead?
 
what status were you in? what does your I-94 say?

in any case, you can't get reinstated and pay any fines.
 
I was in f-1 status for five years, expired in 2004. So is doing CP the only route for me or is there any other way to go about it while still here in the US? Thanks again.
 
if you still have your I-94 and I-20 forms, and everything related to the fact that you have D/S in your I-94, you can do CP. Keep proof of that I-94!!!

if you have never contacted USCIS for anything after you fell out of status, and you were never officially found to be out of status, then you didn't accumulate any illegal presence (yet). Which gives you a chance for consular processing (not AOS).
