Question about Spouse's 485 (Follow-to-Join?)

Hello,

I saw a lot of posts about follow-to-join, but they were mostly 824 related. I also searched the archives, but didn't find answers to my questions. So, here goes....

I had applied for my 485 before my wedding. My wife came here on H4 and then we applied for her 485. She got her 2nd EAD recently and is waiting on her 2nd AP. She completed her FP in Jan 2005 and there are no updates to her 485. Her case status says it'll take 850 to 900 days to process such cases. Her RD is Aug 17th 2004.

My 485 was approved in Dec 2004 and I got my card in Jan 2005. With this info, I have the following questions.

1. Is my wife's case considered Follow-to-Join?

2. Is there a specific date (like the PD for EB cases, 824 etc) for dependents? In other words, on what date will her approval be based on? Is there an official link or a document that contains this information, like the USCIS processing dates?

3. Is there anything I can do to follow-up on her case, like call the customer service number? If I call, is this considered a seperated case or just a different one?

4. I had sent a mail about her name check about 6 months back and haven't heard anything. Anything else I can do to see if she's stuck in the name check process?

5. What is biometrics? Is it something new? I saw it mentioned in the forums and didn't know if its different from finger-printing. If my wife has to undergo biometrics, how will she get notified?

6. Anyone else in the same boat?

Hello, I don't know too much about follow to join, but:

1. It is my understanding that for to be follow-to-join benefits is because you filed an I-824, did you?
It is my understanding too, that she filed her I-485 before you get your GC or it was after?

2. If her I-485 is pending you have to wait and check your DO processing dates at www.uscis.gov (at your left there is a part of Case Status Online and Processing Dates). You must have her receipt number of her I-485.

3. Same as 2. Or you can call the Customer Service and she should have her receipt number.

4. I don't know. You can send an email to the FBI to see if there is something with her name check and as I read in other threads in this same forum (you can check out there and ask there) mostly you have to wait.

5. Part of the I-485 process is to have FP & Bio done. Fingerprinting is to take from each finger its prints, Biometrics they take a digital picture of you and your signature that have some unique characteristics. As I found in other threads they use that picture for your GC. I am not sure but I think by the last quarter of last year is that they started using Biometrics. As I said I am not sure, I am still searching.

Derivative Adjustment

1. No, we did not have to file 824. That is for consular processing, correct? She came on H4 and her 485 was filed here. The receipt says its derivative adjustment.

2. Those dates are only for 824/EB etc. That's why I asked the question, is there a specific date and if so, is it published somewhere?

4. I did send the e-mail in Jan. Still haven't heard from them.

5. I got my gc in the last quarter of last year (Dec 14th, to be precise). I didn't have to do biometrics. I sent the picutres and the finger-print was taken when I went for my passport stamping. So, My wife already gave her FP in Jan and I'm not sure if she's required to do the biometrics.
 
2. I think since is derivative adjustment is consider through family based if I am not wrong. I am not sure, when you called the Customer Service did you check that out? I mean you can ask them even your wife is by derivative adjustment you just have to look for processing dates on I-485 (family based).

4. Same thing as before, I think you will have to wait. Check out the posts about "name check" But you shouldn't worry because the name check doesn't affect the interview letter itself, affects to get the stamp after the interview!

5. That is probably you didn't heard about biometrics. Well, if they didn't ask you for more information you just should wait. What you can do is to ask if there is a pending information from your wife (problems in the mail or something) and there is something that you have to send?? Normally the USCIS send a RFE when they need further information or a letter saying that she needs to do biometrics.
