thanks everyone i found many useful information here. so want to know whether anyone has experience of submit spouse's 485 after primary applicant submitted 485 frist.

here is my situation:

i submitted my 485 application after 140 was approved at 6/2005 without including my husband. he was under F1 at that time. and unfortunately he had a family medical emergency need travel out of country to take care. so we couldn't include him. I will have my FP done this friday. and He will come back to USA under H4 visa sunday. then we are planning to file his 485 monday.

is there anyone has some situation such as submit 485 seperated? what would happened to both case? is there possibility his will get approved seperated since he still need to wait for FP?

thanks a lot if you can share any information.

They will be processed separately. If he is lucky he will be approved alongwith with you. If not, he will get approved separately - probably later. I saw couple of cases where both got approved same time, even though spouse filed his/her I-485 months later. But most of the cases, including my wife's case, they are processed and approved separately.

thanks for sharing one more question

your information is very help. thanks very much for sharing. would you mind to share for your wife's case how late it from yours? since now the time is really critical for the EB2 case, as we know the cut off data might be set up by the end of the year.

Even though my wife filed just 2.5 months after me, she had to wait 2 more years to get approved (mine got approved on 2002 Feb and she got approved on 2004 May). But I believe that was a special circumstance after post 9/11 backlog (in 2002-2003). My case was lucky to be approved before backlog started and my wife's could not make it.

Backlog was the culprit.

I have a friend who got her GC few days before her husband & she applied almost six months after primary applicant.
