Question about NIW

Okay I am befuzzled about this.

One of my co-workers recently asked me to provide her with a recommendation letter that would support her case for NIW (National Interest Waiver).

She has tried this approach before and has gotten a denial. INS's response looked like as below -

“Labor certification would be adverse to the national interest:

The record does not satisfactorily establish that you are more capable than others with similar technical qualifications of education and experience. Therefore, the record does not establish that you will serve the national interest to a substantially greater degree than would an available United States worker having the same minimum qualifications.

While the record contains letters of recommendation, these letters are mostly from past and present co-workers or superiors. The record does not contain letters of recommendation from impartial experts in your field who are well outside your own circle of collaborators and superiors and who attest to your significant impact in your field.

While the national interest waiver hinges on prospective benefit, it must be clearly established that the beneficiary's past record justifies projections of future benefit to the nation.”


She is really keen to try twice because otherwise she would be stuck in the EB3 category, which I understand takes awfully long these days to process (labor atleast).

Now I am kind of her co-worker (She is a team member of one of my peer's teams). As per her a letter from me would help her case because (as per her) I have above average background. I am not a Phd or anything, just well recognized in my field of work, thats all.

My question - Does a letter of this kind put me in any kind of jeopardy? Should I give this letter to her? What kind of questions may INS ask of me if I were to give such a letter?

Yes!!! silly man is the best burger tosser McDonald's has ever produced. He is well recognized in this line of work....I can attest to that.
 
1. as long as you are honest with what you are saying, there is no issue.
2. as to the effectiveness of such letter from person who are not "the leaders" in their fields (no offense..), or have not won noble prize, or are not deans of Yales, MITs, or not chief of NASA (I think you got the point).... it is just waste of time and money for the person obtaining these and applying under NIW based on such letters (among other things).

7-8 years ago, one of my coworker got it approved under NIW (she was my tester, nothing to show...and in fact she was very very bad engineer) just because she did 2 months internship at NASA. That was the begining of NIW. Things has changed in last 6-7 years. Now, unless you are a well known figure, have international grade research and awards to show, have letters from very high profile leaders in the field.... chances of getting it under NIW are poorer than winning Mega Lotto.

Tell her the meaning of NIW - National Interest Waiver. What makes her person of "national interest"? If he/she can answer this question, she should go ahead, otherwise she should "wake up".

Thank you for your reply goodsaint. Considering everything and what you mentioned above, I have decided against giving her a letter. I am no chief of NASA or anything, but I honestly believe she isn't a Monica Seles either. I myself went through the process the hard way, and I didn't quite want to put her in front of any other deserving candidate.
