What are the consequences of applying for I 130/I 485 if someone married a USC who filed I 130 earlier for ex wife (married for 6 years and divorced a year back).The new marriage is a genuine marriage like his old marriage with all familty members present and the present wife is legally working on H1B for 4 years.Is there something to worry about applying for I 130/I 485 or just go through greencard from emploment based.This is for a close friend of mine and there is absolutely no fraud intent.The yare planning to hire a lwayer anyway but I would really appreciate your thoughts on this.
