Question about H4 visa stamping

Hello All,

I have my H1B visa appointment in Vancouver consulate on Monday. This was an extension which wa filled by my company. Company filled my H1B in premium processing. However now I have received my H1B petition filled for extension but my lawyer has still not recieved my wife's H4 petition ( filled with the extension ). INS website shows with the EAC number that her petition is also approved but still in transit.

Now my question is if this is OK to go for stamping in Canada with with my I-797 ( petition ) for my H1 and my wife H4. According to my Lawyer it is not necessary to have H4 extension petitoin for stamping as long as I have my petition.

Just wondering if anybody has encouentered this and has any idea.

Visa stamping - if you have valid H1b approval you can stamp h1 visa.
If you have valid H4 approval you can stamp H4 visa.

Only first time you do not need any papers to stamp H4, based on your H1 it will be stamped. Subsequent H4 extn especially out side your home country definetly needs an H4 petition approval.

Hi Guru,

Thanks a lot for reply. Actually I was working in Denver with the same company and I have H1 and H4 petition from that time. Later I changed location and company filled for my new LCA and extension at the same time. I dont have H4 petition for this extension... Can I use the H4 extension petition from that previous H4.
