Question about Filling for Citizenship

Hi,

First of all I apologize if I am posting this question on the wrong forum.

My wife is a permanent resident and she will be filing her citizenship in July 2007 (After 4 years and 9 months). I am on my H1B visa. Is there any forum or way that I can file something with her to be secure. The reason I am asking is that I might change my job but I want to be secure. So that if something bad happens (layoff) I won't be illegal in USA.

So, can I file I-485 when she submits her citizenship paper? Or can I file anything at all to stay safe?

Also how long does it usually take to get the citizenship after filing it? I live in Houston TX.

Also after my wife gets citizenship how long does it take me to get EAD?

Once she becomes a US citizen, she can file for AOS for you and you will be legal.
So, can I file I-485 when she submits her citizenship paper? Or can I file anything at all to stay safe?
Yes. Only when she becomes a US citizen though, until then you are not "safe".

About 90 days after you file for it (along with your AOS).

not until after she becomes a citizen (oath day). That's when you can file I-485 and I-765 (for EAD) and then you can change employer without transferring your H1B.

In all other cases, you need to transfer and maintain your H1B until you file for AOS. It takes about 3 months to get EAD after you file for AOS.

Hi, I am a USC filing for my wife. She is her in the US legally under an OPT Visa. I sent my I-130 in April separately. Her I-485 was rejected. Now I am told her application and mine should be filed together. Should I request a withdrawal of my I-130 and resubmit both applications together, or just submit her application with a copy of the receipt for the I-130?
 
My wife's OPT Visa is going to expire in August. If her application for status adjustment (I-485) is not approved by then, will she have to return to her country, or can she remain in the US while the application is pending?
 
she can remain in the US while her AOS is pending.

By the way, there is no such thing as OPT visa. You wife is still in F-1 status.
