I got my GC on June of 2006 based on asylum. I have been married to a us citizen since 10/2005. Can i apply for citizenship now ( on march 27) 90 day before complete 3 years ? I followed uscis eligibility work sheet and it shows that i am eligible and also called uscis and they told me the same. I just want to make sure.

Thanks alot

Yes, you can as long as your spouse has been a US citizen for at least three years on the date you file.

As an asylum based cased, your residency status is backdated 1 year, so if your AOS was approved in June 2006, you've been a LPR since June 2005 and therefore would already be eligible to apply since you've been married to US citizen for over 3 years.

When can I file for my U.S Citizenship

I am a U.S permanent resident since Oct 2004. I would like to know how many days before, can I apply for my U.S citizenship. The naturalization guide says that I can apply 90 days before I meet my continuous residence in U.S. The continuous residence requirement as mentioned in the naturalization guide is that I be in the U.S for 180 days every year since I got my GC. If I am right can I apply 90 days before my 180 days in my 5th year of my GC, i.e after 3 months in the 5th year.

Please clarify. Any information is greatly appreciated.

Thanks,

Yes, you can apply 90 days (not 3 months) before your full 5 years, that is, 90 days before the day you became LPR in October 2004.

MR Vertigo

I received my green card August 27th 2004. That is what it says on my green card based on that date, am i going to be eligible to pay May 27th 2009 ? Is that the correct calculation ? Thanks.

No. 90 days before August 27 is May 29. That's because July and May have 31 days.

Citizenship eligibility question

I got my PR through employer in 6/2004. I left for my home country in 6/05. I filed my AR-11 with my home country address in 6/05. I returned back to US in Nov05 and then went back to home country in Dec 05. Then I moved back to US in Jan 06.I filed AR-11 with new address in Jan 06.Since then I had 2 short trips outside US. So, when am eligible to apply for citizenship?

For my wife. Its the same but after NOv 05 she left US in Dec05 and returned on 2/6 and went back again on 3/6 and came back on 5/6 . so, when can she apply.

Any ifo is greatly appreciated.
Thanks

You should not have filed AR-11. The purpose of AR-11 is for the Immigration authorities to track your location within the US. You are not required to file it to tell them your location outside the US.

Anyway, your trips are not long enough or frequent enough to trigger a break in continuous residence. So both you and your wife can go ahead and apply on or after the 90th day before your GC anniversary, which would be sometime this month or early next month depending on the exact day your GC was approved (just remember to do a separate date calculation for your wife if she did not get her GC approved on the same day as you, and avoid applying on the exact 90th day in order to protect yourself from USCIS rejecting it because of their date counting mistake).

A speeding ticket is a citation so you should list it on the application although some have not deemed it as such and did not do and were fine.
